Atlas Travels is a website operated by Atlas Travels Leicester Limited. Atlas Travels Leicester Limited is a Travel Agency, with a registered office at 128 Evington Road Leicester LE2 1HL (hereinafter referred to as “we,” “us” or “our”).

These terms of use set out the basis on which the users (“you,” “your,” and “user”) can access and use the Atlas Travels website (“Website”). By using the Website, you confirm that you accept these terms of use and you agree to be bound by them and to comply with them. If you do not agree to these terms of use, you must not use the Platforms. 

1 ADDITIONAL TERM

All bookings are subject to our Booking Terms & Conditions. In the case of conflict between these Terms of Use and the Booking Terms & Conditions, the Terms & Conditions shall prevail. 

Our Privacy Policy and Cookie Policy provide information on the way in which we process personal information and use cookies and also govern your use of the Website. Please ensure you have familiarised yourself with these policies. 

2 USE OF THE WEBSITE

You must only visit the Website and use its functionality for personal, non-commercial, and lawful use, for the purposes of:

• obtaining information and checking the suitability and availability of our products and services;

• purchasing our products and services (and for purposes legitimately connected thereto); or

• accessing details of products and services that you have purchased, managing your bookings, managing your preferences, and accessing support from us.

• use any automated software or system, whether operated by a third party or otherwise, to extract data from this Website for any commercial purpose (otherwise known as "screen scraping"); 

• use this Website in a way that causes or may cause an infringement of the rights of any other party, including intellectual property rights, or which breaches any standards, regulations, or codes published by any relevant authority; or

• use this Website to make any unauthorised, unlawful, false, or fraudulent reservation or amendments thereto.

Atlas Travels may, at any time, in its sole discretion and without notice, suspend, withdraw, or restrict any user's access to the Website.

3 ACCOUNT SET UP

When you make a booking with us, a customer/user account (“Account”) in Manage My Booking will be created. After you have made a booking, you will be able to request access to Manage My Booking by providing the lead passenger's surname and booking reference and a secure link will be sent to the lead passenger's email address to grant access. You may use this customer account to view and manage your bookings. It shall be your sole responsibility to keep access information secret. 

You agree not to (1) misrepresent yourself as someone else by selecting or using a username a name, email, or phone number of another person; (2) use, as a username, an offensive, vulgar, or obscene name; (3) use as a username a fictitious name or pseudonym.

You are solely liable and responsible for any activity that occurs on your Account. You agree and understand that you shall not share your user Account email address or booking reference with anybody or do any such act which promotes unauthorised use of your user Account. You shall take all measures to protect your email address and booking reference, including but not limited to, restricting the use of your personal device.

You must notify us immediately on our Website of any change in your eligibility to use the Website, breach of security, or unauthorised use of your Account. You understand and agree that on booking at our Website, you agree to receive communication concerning marketing emails and SMS from us. You understand and agree that any communication or notification you receive from us electronically shall qualify as legal notice and meet all the legal notice requirements.

4 INTELLECTUAL PROPERTY

You acknowledge that all intellectual property rights in the content and information on this Website, including (without limitation) all text, data, software, content, music, sounds, trademarks, service marks, logos, graphics, photographs and images, video, and any other content on the Website (the "Content") are the exclusive property of Atlas Travels and/or its license holders. You acknowledge and agree that you will not acquire any rights in or to any Content and/or the Website, save for use in accordance with these terms of use.

Whilst Atlas Travels attempts to ensure all Content is accurate, the Content is provided "AS IS" and on an "AS AVAILABLE" basis. We do not guarantee that our site, or any Content, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.

To the extent permitted by applicable law, Atlas Travels expressly excludes all liability whether arising in contract, tort, or otherwise (including, but not limited to, liability for any negligent act or omissions) arising directly or indirectly from (i) the use of the Website and/or the Content on the Website and (ii) anything done or omitted to be done wholly or partly in reliance upon the whole or any part of the Content of this Website.

None of the disclaimers and exclusions of liability in these terms of use shall apply to any liability arising from death or personal injury caused by the negligence of Atlas Travels or Atlas Travels’ fraud.

11 LAW AND JURISDICTION

These terms of use are governed by English law and the courts of England and Leicester have exclusive jurisdiction over any dispute or matter arising out of these terms of use.

12 DISPUTE RESOLUTION

Any dispute concerning the subject matter of these terms of use, or the breach, termination, or validity thereof (a “Dispute”) will be settled exclusively in accordance with the procedures set forth herein. The party seeking resolution of a Dispute will first give notice in writing of the Dispute to the other party, setting forth the nature of the Dispute and a concise statement of the issues to be resolved. If the Dispute has not been resolved through good faith efforts and negotiations of senior officers or representatives of the parties within fifteen (15) days of receipt by the relevant party of the notice of Dispute, such notice will be deemed to be a notice of arbitration and the parties agree to submit the Dispute to a single arbitrator mutually agreeable to both parties. The venue of such arbitration shall be Leicester. In the event that the Parties cannot agree on a sole arbitrator, the arbitrator will be appointed by a judge of the appropriate court on application by either party to the Dispute. All decisions and awards rendered by the arbitrator will be final and binding upon the parties for all questions submitted to such arbitrator, and the costs associated with such submission shall be shared equally by the parties involved in the Dispute unless the arbitrator decides otherwise. The parties waive all rights of appeal, therefore to any court or tribunal, and agree that the only recourse by any party to any court will be for the purpose of enforcing an arbitration award.

13 MISCELLANEOUS

You warrant and represent to us that you have all necessary rights, power, and authority to agree to these terms of use and perform your obligations hereunder, and nothing contained in these terms of use or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these terms of use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms of use will otherwise remain in full force and effect and enforceable.
